Victory in USSC Perez Case!

Washington, DC, Today, with a unanimous decision 9-0, the U.S. Supreme Court (SCOTUS) has agreed with plaintiff Miguel Perez in Perez vs. Sturgis, that Perez may pursue damages claims under the Americans with Disabilities Act (ADA) and that the Individuals with Disabilities Education Act (IDEA) does not preclude his ability to do so.

The decision delivered by SCOTUS was written by Justice Neil Gorsuch and  explained the provisions of the IDEA and wrote, "...We [the Court] clarify that nothing in IDEA [Section 1415 (l)] bars his way. The judgement of the Court of Appeals is reversed and the case is remanded for further proceedings consistent with this opinion."
